Probate Terminology

Executor, Beneficiary, Intestate, Conservator, Per Stirpes...What does it all mean? Probate uses a whole new language that you're unprepared to speak. Below are some of the most common terms you're going to be faced with during the probate process.


  • Probate- Probate is the legal procedure of settling an estate. During this process the probate court determines whether the decedent's will (if one exists) is valid is invalid and appoints someone to administer the estate until it's settled
  • Testator- A person who has made a will
  • Estate- A person's total assets
  • Executor/Executrix (f)- The person designated in a will, or named by the court to manage or settle the estate of a deceased person. 
  • Will- A legal document that gives directions for the distribution of a person's assets upon their death
  • Administrator- A person appointed by the court to administer the estate of a person who died without a will
  • Fiduciary- A person of entity that manages the assets of another with a legal responsibility and high standard of care
  • Intestate- Someone who dies without a valid will
  • Heir- A person entitled to a share of an estate
  • Conservator- A person or entity appointed by the court to manage the personal or financial affairs of an adult (Conservatee)
  • Testate- Someone who dies with a will
